Yayın A case study of cyanide gold mining: the iliç landslide analysis from the perspective of ecocide and international law(Yozgat Bozok University, 2025) Bozkurt, KutluhanThis study evaluates the incident associated with cyanide gold mining, and the ecological disasters that have occurred and/or may arise as a consequence, analyzed through the lens of international law and in terms of cross-border regulations. This evaluation will consider the inclination of international public opinion to characterize ecocide as an international and universal crime, particularly in recent years. This perspective examines the potential for preventing cyanide gold mining activities through international legal regulations concerning ecocide and ecocide crimes. It analyzes the disaster resulting from the 2024 inicdent at the cyanide gold mining site in İliç, Erzincan/Türkiye. This discussion explores the potential for international liability arising from aggressive, risky, and hazardous mining activities. Cyanide gold mining poses significant risks to the planet and its ecosystems, underscoring the necessity for robust environmental protection regulations. The definition and acceptance of ecocide as a universal crime has emerged as a significant phenomenon in this context.Yayın Advancing ecocide in international law: a potential legal tool for safeguarding endangered species amidst climate change(Inonu University, 2024) Bozkurt, Kutluhan; Nemec, Elif NazThis article highlights the need to formalize a legal framework regulating the ecocide crime in international law, within the context of climate change that causes a biological diversity crisis in today’s world. Accordingly, this study’s main argument is to advocate for a definition to be adopted at international level, which will encompass elements of the ecocide crime. The study evaluates existing international legal instruments as the Geneva Conventions and the Rome Statute, highlighting their limitations in adequately addressing environmental harm. Elaborating ecocide with its criminal dimension in international law has a very crucial function for the protection of the elements of biological diversity, particularly, the endangered species which are currently facing with an existential danger in the face of human-induced climate change. The necessity of an international effort to define ecocide is clear. Adoption of a new Jus Cogens rule recognizing the rights of the environment will ensure the legal protection of nature and reinforce sustainable practices on a global scale. There is no doubt that for this to happen, an ecocentric approach that centers on the right to the environment and, more broadly, the legal personality and rights of the planet must be adopted.Yayın Assessments on the Ukraine-Russia war in the axis of international law and ecocide crimes(Yeditepe University, 2024) Bozkurt, Kutluhan; Ahmet Çitköylü, Kutluhan BozkurtThe article titled "Uluslararası Hukuk ve Ekokırım Suçlar Ekseninde Ukrayna-Rusya Savaşına İlişkin Değerlendirmeler (Assessments on the Ukraine-Russia War in the Axis of International Law and Ecocides Crimes)" was published in Yeditepe University's Journal of Law Faculty, 2023 – Volume: 20, Issue: 2. The author analyzes ecocide crimes in the context of the Ukraine-Russia War within international law. The author asserts that armed conflicts and weapons not only lead individuals, societies, and states to disaster but also expose the planet and its ecosystem to irreparable damage and destruction. Furthermore, the author explains that the inadequacies of international law in protecting nature, or in other words, the planet and its ecosystem, are evident. Therefore, the author argues that it is necessary to define "Ecocide Crimes" and establish new and effective regulations accordingly. In conclusion, the author emphasizes the importance of giving the planet legal personality, recognizing the planet's right to selfdetermination, and advocating for the creation of a "Universal Declaration of the Rights of the Planet." Ukrayna-Rusya silahlı çatışmalarının ki artık bir savaş haline dönüşmüştür bu süreç, bölgede, coğrafyamızda ve sonuç itibariyle doğada kalıcı izler ve hasarlar bıraktığı ve daha da bırakacağı görülmektedir. Doğanın başka bir ifade ile gezegenin ve onun ekosisteminin korunması için uluslararası hukukun yetersizlikleri görülmektedir. Bu yetersizliklerin aşılması noktasında “Ekokırım Suçlar” tanımlamasının yapılması ve buna uygun yeni ve etkili düzenlemelerin oluşturulması gerekmektedir. Bu bağlamda gezegene bir hukuki kişilik verilmesi, gezegenin kendi kaderini tayin hakkının var olduğunun kabulü ve en nihayetinde bir “Gezegen Hakları Evrensel Beyannamesinin” oluşturulması artık uluslararası toplum tarafından tartışılmalıdır. Ukrayna- Rusya savaşı bu gerekliliği bir kez daha bizlere göstermektedir.
