| dc.description.abstract | Küresel ölçekte yaşanan bilimsel ve sosyolojik değişimler tarih boyunca din ve inanç olgularının bireysel ve toplumsal çerçevede etkileri pek çok disiplininin araştırma konusu olmuştur. Bu çerçevede kamusal alan ve bu alanın nitelikleri, bu alanda yaşanan din ve inanç gibi toplumsal olgular, din özgürlüğü ve sınırlılıkları sürekli değişen ve gelişen olgular olarak hem sosyolojik hem de hukuksal sonuçlar türetmektedir. Toplum içinde ve toplumlar arasında hiyerarşiyi korumak ancak eşitlik ve adalet olgularının doğru uygulamaları ile mümkün olmaktadır. Bu nedenle anayasal hukuk kuralları, yargı içtihatları ve uluslararası sözleşmeler ve bildirgeler rehberliğinde eşitlik ve özgürlük korunmaktadır. Demokrasi ve özgürlüğün eksik olduğu toplumlarda temel hak ve özgürlüklerin doğru uygulanamaması toplum içinde ve arasında çeşitli tartışmalara ve çatışmalara neden olmaktadır. Bu bağlamda anayasal zeminde bireysel ve kamusal hakların ve özgürlüklerin korunması ve gerektiğinde sınırlandırılması gerekli olmaktadır. Toplumsal değişimlerin ve etkilerinin incelenmesine yönelik yapılan bu çalışmada; kamusal alan, bu alanın gelişimi ve demokrasi ile ilişkisi; kamusal alanda din özgürlüğü ve sınırları, kamusal alanı din ve demokrasi çerçevesinde sekülerizm ve laiklik olguları ve bu olguların toplumsal yansımaları değerlendirilmiştir. Sonuç bölümünde ise değerlendirilen olguların toplumsal sonuçları ve etkileri genel olarak değerlendirilmiştir. | |
| dc.description.abstract | The scientific and sociological changes experienced on a global scale throughout history, and the effects of religion and belief phenomena in individual and social contexts have been the subject of research in many disciplines. In this framework, the public sphere and its characteristics, social phenomena such as religion and belief experienced in this field, and freedom of religion and its limitations generate both sociological and legal consequences as phenomena that are constantly changing and developing. Preserving the hierarchy within the society and between societies is only possible with the correct application of the facts of equality and justice. For this reason, equality and freedom are protected under the guidance of constitutional law, judicial jurisprudence, and international conventions and declarations. In societies where democracy and freedom are lacking, the inability to apply fundamental rights and freedoms correctly cause various debates and conflicts within and between the society. In this context, it is necessary to protect and, if necessary, limit individual and public rights and freedoms on a constitutional basis. This study was conducted to examine social changes and their effects; on the public sphere, its development and its relation with democracy; religious freedom and boundaries in the public sphere, secularism and secularism in the public sphere within the framework of religion and democracy, and the social reflections of these phenomena were evaluated. In the conclusion part, the social consequences and effects of the evaluated cases were evaluated in general. | |
