Özet
Türk Hukuku'nda meşru savunma, hukuka uygunluk sebepleri arasında sayılmıştır. Meşru savunmada saldırıya ve savunmaya ilişkin şartların mevcut olmalıdır. Saldırıya ilişkin şartlar; saldırının hakka yönelmiş olması, saldırının haksız olması, saldırının güncel olmasıdır. Savunmaya ilişkin şartlar ise; savunmanın zorunlu olması, savunmanın saldırana yapılması ve ölçülülüktür. Irak Hukuku'nda, Türk Hukuku'nda olduğu gibi meşru savunma hukuka uygunluk nedenleri arasında sayılmıştır. Irak Hukuku'nda da meşru savunmada saldırıya ve savunmaya ilişkin şartlar mevcut olmalıdır. Meşru savunmada saldırıya ilişkin şartlar, tehlikenin varlığı, tehlikenin ani olması tehlikenin hukuka aykırı olması, meşru savunmada savunmaya ilişkin şartlar ise; savunmanın gerekli olması, savunma ile tehlikenin ağırlığı ile orantılılığı üzerinden kabul görmektedir. Her iki ülkede de düzenlenen bu konuda farklılıkların bulunduğu gibi benzerlikler de mevcut bulunmaktadır.
In Turkish Law, the right of legitimate defense is counted among the reasons for compliance with the law. The terms of the defense are; the defense must be mandatory, the defense must be made to the attacker and there must be proportionality conditions. In Iraqi Law, it is accepted that there are conditions for attack and conditions for defense in self-defense. The conditions regarding the attack in the legitimate defense, the existence of the danger, the suddenness of the danger, the illegality of the danger, and the conditions related to the defense in the legitimate defense; the necessity of the defense is accepted on the basis of the proportionality of the defense and the gravity of the danger. There are similarities as well as differences in this issue regulated in both countries.
