dc.description.abstractTrafik kazalarında insanların hayatını kaybetmesi ve geride ailelerini bırakmasına yol açmaktadır. Bunun yanında bazen de meydana gelen kazalar neticesinde hayatını kaybedenlerinin ailelerinin refah seviyesi ve maddi durumlarını da etkilenebilmektedir. Kanun koyucu bu durumu koruma altına alabilmek adına hukuk sistemimizde diğer hukuk sistemleri ile bağlantılı olarak bir takım düzenlemeler getirmiştir. Trafik kazalarının yaşanmasında en büyük etken kullanan sürücünün Karayolları ve Trafik Kanununa aykırı hareket etmesidir. Bunun sonucunda üzücü bir şekilde tek yönlü ve çift yönlü trafik kazları meydana gelir. İşte tezimizde ilk bahsedeceğimiz konu; kusur dağılımının belirlenmesidir. Bunun devamında bu kaza sonucunda kalıcı olarak ömrünün sonuna kadar hissedecekleri kalıcı hasarlara maruz kalan kaza zedelerin her ne kadar acılarını dindiremeyecekte olsa, kaza sonucu hak kazandıkları sürekli iş gücü tazminatının nasıl belirlendiğinin hesaplanmasıdır. Yine kaza sonucu ölen bir kişi varsa, ölen kişinin maddi ve manevi desteğini hissedecek kişinin bu desteğinden mahrum kalması sonucu bir nebze olsun acısını dindirmek için alabileceği destekten yoksun kalma tazminatın elde etmesidir.
dc.description.abstractTraffic accidents cause people to lose their lives and leave their families behind. In addition, sometimes the welfare and financial situation of the families of those who lost their lives as a result of accidents may be affected. In order to protect this situation, the legislator has introduced a number of regulations in our legal system in conjunction with other legal systems. The biggest factor in traffic accidents is the driver's violation of the Highways and Traffic Law. As a result, one-way and two-way traffic accidents unfortunately occur. Here is the first topic we will talk about in our thesis; is to determine the defect distribution. What follows is the calculation of how the permanent labor compensation to which the accident victims are entitled as a result of the accident is determined, even though it cannot relieve the pain of the accident victims who are exposed to permanent damage that they will feel for the rest of their lives as a result of this accident. Again, if there is a person who dies as a result of an accident, the person who will feel the material and moral support of the deceased is deprived of this support and thus receives compensation for being deprived of the support he/she can receive to relieve his/her pain to some extent.
