dc.description.abstractOrman suçları uzun bir süre ceza hukuku biliminin ilgisini tam olarak çekememiş ve tıpkı diğer çevre suçları gibi üvey evlat muamelesi görmüştür. Orman suçları içerisinde de orman yakma suçları, hem yarattığı toplumsal tepki hem de içerisinde barındırdığı çeşitli sorunlar nedeniyle özellikle tartışmaya muhtaç bir suç türüdür. Özellikle orman kavramına orman yakma suçları kapsamında tam bir açıklık getirilmek durumundadır. Orman kavramının lafzi ve biyolojik anlamda tanımları orman idare hukuku mevzuatı tanımlarından farklılaşabilmektedir. Bunun yanında orman ceza hukuku açısından ceza hukukunun özerkliği de göz önünde bulundurularak bir değerlendirmede bulunmak gerekecektir. En nihayetinde orman suçları kapsamının de lege ferenda genişletilmesi de icap etmektedir. Bu bağlamda makale kapsamında orman yakma suçlarına ilişkin tartışmalı bazı ana hususlara içtihatlar da göz önünde bulundurularak değinilmeye çalışılacak, olması gereken hukuk açısından da bazı önerilerde bulunulacaktır.
dc.description.abstractForest crimes have not attracted the attention of criminal law science for a long time, and just like other environmental crimes, they were treated as a stepchild. Among the forest crimes, crimes of setting forests on fire are a type of crime that needs discussion especially because of the social reaction it creates and the various problems it contains. The literal and biological definitions of the concept of forest may differ from the definitions of forest administration and criminal law legislation. In addition, it will be necessary to make an evaluation in terms of forest criminal law. As a de lege feranda it is necessary to expand the scope of forest crimes. In this context, within the scope of the work, some of the main controversial issues related to crimes of setting fire to forest will be tried to be addressed by taking into consideration the jurisprudence, and some suggestions will be made in terms of the law that should be
