6413 sayılı TSK Disiplin Kanunu'nda yer alan disiplin cezaları ile bu disiplin cezalarına karşı itiraz ve yargı yolu

Özet
Disiplin kavramının tanımından yola çıkarak yapılan bu çalışmada, bu kavramın özellikle etkin bir silahlı kuvvetler oluşumunda ne denli önemli bir yer teşkil ettiği örnekler verilerek ifade edilmeye çalışılmaktadır. Bu kapsamda disiplinin tesisini sağlayacak en önemli araçların başında yer alan disiplin mevzuatının genel anlamda çerçevesi belirlenerek, bu mevzuatın temelinde yer alan 16 Şubat 2013 tarihinde yürürlüğe giren 6413 sayılı TSK Disiplin Kanunu'nun uygulaması kaynağını insan haklarına ilişkin uluslararası anlaşmalar, Anayasa ve ceza kanunlarından alan temel ilkeler çerçevesinde irdelenerek genel hatlarıyla ifade edilmeye çalışıldı. Bu uygulamada yer alan itiraz ve kanun yoluna da değinilerek, hangi disiplin cezalarında hangi kanun yollarına başvurulabileceği hususlarına da özellikle yapılan çalışmada yer verilmiştir. Yürütülen çalışmada yokluk denetimi olarak adlandırılan denetim hali de mevcut yargı kararları üzerinden aktarılmaya çalışılmıştır. Yapılan çalışmada 6413 sayılı TSK Disiplin Kanunu'nun sistematik düzeni de incelenen hususlar arasında yer almıştır. 2013 yılında yapılan değişiklik sonrasında yürürlüğe giren 6413 sayılı Türk Silahlı Kuvvetleri Disiplin Kanunu'nun uygulaması açısından, yakın sayılabilecek bir zamanda yürürlüğe girmiş olması ve 2017 yılında yapılan Anayasa değişikliği sonrasında, askeri yargı alanında yapılan köklü değişiklikler nedeniyle yaşanan uygulama sıkıntılarının giderilebilmesi amacıyla yürütülen bu çalışmanın, özellikle Türk Silahlı Kuvvetleri'nde disiplin amiri, disiplin subayı ya da disiplin kurullarında görev yapan personele yol göstermesi hedeflenmiştir.
In this study, based on the definition of the concept of discipline, it is tried to express by giving examples how important this concept is, especially in the formation of an effective armed forces. In this context, the general framework of the disciplinary legislation, which is one of the most important tools to ensure the establishment of discipline, has been determined and the implementation of the Turkish Armed Forces Disciplinary Law No. 6413, which came into force on February 16, 2013, which is the basis of this legislation, is based on international agreements on human rights, the Constitution and criminal laws. It was tried to be expressed in general terms by examining it within the framework of the principles. The objection and legal remedies in this practice were also touched upon, and the issues that could be resorted to in which disciplinary punishments were made in particular were included in the study. In the study conducted, the audit situation called absence audit was tried to be conveyed through existing judicial decisions. In the study, the systematic order of the Turkish Armed Forces Disciplinary Law No. 6413 was also among the issues examined. Turkish Armed Forces Law No. 6413, which came into force after the amendment made in 2013 in a near future in terms of the implementation of the Forces Disciplinary Law, after it entered into force and the Constitutional amendment made in 2017, this study, which was carried out in order to eliminate the implementation problems experienced due to the radical changes made in the field, is aimed to guide especially the disciplinary chiefs, disciplinary officers or personnel serving in disciplinary boards in the Turkish Armed Forces.
