Elektrik piyasasındaki uyuşmazlıkların arabuluculuk yoluyla çözülmesi

Türkiye'de elektrik piyasasi yeni yatirimlar ve düzenlemeler ile önemi her geçen gün artmaktadir. Elektrik piyasasi, enerji kaynaklarinin etkin bir sekilde kullanilmasini, ekonomik büyümeyi desteklemeyi ve çevresel sürdürülebilirligi saglamaya yönelik etkin bir araçtir. Elektrige olan ihtiyacin her geçen gün artmasiyla birlikte yasanilan sorunlarin hizli ve etkin bir sekilde çözülmesi gerekmektedir. Türkiye'de giderek önemi artan, yarginin yükünü hafifleten ve adalete erisimi hizlandiran alternatif çözüm yöntemlerinden biri olan arabuluculugun elektrik piyasasinda yasanilan uyusmazliklarindaki rolü ele alinarak elverisli olan durumlar ve elverisli olmayan durumlar üzerinde degerlendirilme yapilacak olup, yasanilan uyusmazhiklardaki etkisi, faydasi, yasal mevzuat, doktrindeki görüsler ve yargisal kararlar cerçevesinde ele alinacaktir. Bu çalismada elektrik piyasasindan kaynaklanan, günümüzde yasanilan ve gelecekte yasanabilecek sorunlar ortaya konup, arabuluculuk yöntemi ile nasil hizh ve sonuç odakli çözüme kavusmasi gerektigine iliskin yollar tartisilacaktir. Elektrik piyasasi güncel ve sürekli gelisen bir piyasa olup, usul ve yasalarin da sürekli gelismesini mecbur kilmaktadir. Yazilacak tez ile elektrik piyasasindan kaynaklanan uyusmazliklarda arabuluculuk yöntemine elverisli ve elverisli olmayan uyusmazlik türleri tespit edilecektir.
